The former personal attorney for Donald Trump has left her position as New Jersey's top federal prosecutor. This comes after a court battle that questioned her legal standing to hold the office.
Acceptance of Resignation
The head of the Justice Department, Pam Bondi, announced the prosecutor's departure on Monday. Bondi stated that the appeals court finding made it impossible for Habba to effectively run her office.
"Let no one confuse compliance for surrender," she wrote. "The effort will now extend throughout the nation."

Her resignation comes a week after a US appeals court determined that she had been acting without proper authority as US attorney. This decision is likely to affect scores of criminal cases in the Garden State.
The court declared that a temporary posting that bypassed the advice and consent of the Senate breached the Federal Vacancies Reform Act.

Bondi said that the former prosecutor will continue working within the Department of Justice as a senior adviser. She will pursue additional appeals of the disqualification, in the hope of achieving a different outcome.
In a statement, Bondi contended that judges "should not be able to second-guess the President's choice of prosecutors responsible for executing the primary duty of the administration of criminal prosecution."

The attorney general praised the prosecutor's work and noted that while she was in charge, the Newark saw a one-fifth decrease in criminal activity. Additionally that the southern city of Camden had its first summer in 50 years free from homicides.

Habba, was initially recruited to Donald Trump's lawyers in recent years. She later represented the former president in his New York criminal case in 2024, when he was guilty verdict on dozens of charges of falsifying business records.
Before her appointment to the federal prosecutor position, Trump had revealed he was naming her as his presidential counsellor during his second administration, labeling Habba as deeply loyal and a relentless legal advocate.
